Will of John Hewitt, executed 16 Oct 1775 (1776?), probated July Court 1777

In the name of God Amen. I John Hewit of the County of Onslow, planter, being in perfect Helth of body and in perfect mind and memory Thanks be given God Caling to mind the mortality of my body and knowing that it is [appointed?] for all men one to die make and ordain this my last will and testament that is to Say principally and first of all I give and Recommend [my] Soul to God in to the Hands of all mighty God that gave it and my body I Recommend to the Earth to be buried in decent Christain Burial at the discretion of my Executors nothing doubting but at the General Resurrection I shall Receive the Same again by the mighty power of God and as Touching Such worldly Estate Where With it has pleased God to Bles me Within this life I give devise and dispose of the same in the foloing [sic] manner and form

first I give and bequeath to my [missing piece] wife Mary Hewit my [house?] and all the furniture belong to [another few words in another torn section] as long as She lives [otherwise?] after my [death?] and [believing?] that she make no Wast of the Same. I also give and bequeath to my wife my negro man Jack to work and to soport her as long as she shall [be?] singel and then the Sd negro Jack to the property of my Son Thomas Hewit.

I also I [sic] give and bequeath to my son John Hewit a certain parcel of Land being and [_____] part of the Said Track that I now Live on begining at the [north? / mouth?] [_____] that John Hewit Lives on and Runing up the Creek to a Stump calld Cooks Timbr Tree allder post stands by the Sd Stump from This post a straight Line to a cedar post standing in the bed of an old [Tanker?] from thence to the Head of the above Sd. Branch & from thence toward the Varris Coses [various courses] of sd branch to the begining all So

I give and beqeth to my Son Thos Hewit the plantation that I now Live on and all the Land that belongs to the Sd Track except Johns part that I Have given Him

I also Leave my wife in full pension of all the above Said Land that I Have given to my Son Thomas as Long as she Lives a widow

I also give and bequeath to my two Sons John and Thos Hewit all my [piney?] Land belonging to me beginning on the fork of the Boiling Springs Creek divided between them [torn section]

I allso give and bequeath to my daughter Sarah Weeks a certain parcel of Land that I Hold by deed from [blot] Thos Stephens desd [deceased?] being and Lying on a branch of Weeks Creek

the Lands that I Have given to my two Sons John and Thos Hewit to Them and Their Heirs Lawfully begotten and Either of then shall not Bargin or Dispose of any part of Said Land without Consent of Each of Them

I all so Leave all my moveable Estate after my decease and my wife's decease to be [equally? / justly?] divided between my two Sons John and Thos Hewit and my daughter Sarah Weeks except the best feather bed and that to my Son Thos Hewit

they are all to bear an [need?] part of paying my Lawfull debts

I all so give and bequeath to my Son Thos Hewit one hundred acres of Land being & Lying in Will neck upon Queens Creek [complete line illegible because of tear]

ordain the Execution [by?] my son John Hewit of this my Last will and testament all and singular. I do uterly disallow Revoke and disannul all and Every other former Testament Will Legacies [blot] bequests and Executors by me in any way in any way [sic] before named willed and bequethed Ratifying and confirm This and no other to be my Last will and Testament in witness I Have where of I have Set my and and seal the sixteenth day of October 1775 [1776?].
