Estate of Rigdon Hewitt, petition for partition of land, December Term 1843

The Petition of Elijah Hewitt, Edward Hewitt, Abram Hewitt, Caleb S. Hewitt, and Louisa His wife, Rigdon P. Hewitt, John Weeks and Emily his wife, Teresa Hewitt, Willit Hewitt, Desia Hewitt, and [blank] Children of John Hewitt ... sheweth ... that Rigdon Hewitt late of the county of Jones on the [blank] day of A.D. 1842 departed this life intestate leaving him surviving your petitioners Elijah Hewitt, Edward Hewitt, Abram Hewitt, Louisa who intermaried with your petitioner Caleb S. Hewitt, Rigdon P. Hewitt, Emily who intermarried with your Petitioner John Weeks, Teresa Hewitt, Willet Hewitt and Desia Hewitt his Children and [blank] the Children of his deceased son John Hewitt who died in the lifetime of the Said Rigdon Hewitt his grandchildren & all of whom are the heirs at law of the Said Rigdon Hewitt decd. ... the said Rigdon Hewitt died seized of Several tracts of land in fee Simple lying and being in the County of Jones viz.

one tract of Piney land on Black Swamp adjoining the lands of [Simmons] Collins & the heirs at law of Job Meadows, all of which descended to your petitioner in the proportion of one tenth to Each of your Petitioners ...

Petitioners ask the court to appoint commissioners to partition the land.

Estate of Rigdon Hewitt, division of land (including plat), Pollockville 24 Feb 1844

... we find the value of the several tracts of land belonging to the decd ... to be Fifteen hundred Dollars which sum divided in ten shares the number of heirs of said decd is one hundred and fifty Dollars each and set off the said several tracts of land in ten lots agreeable to the above plats ... each of which lots is valued at one hundred and fifty Dolalrs.

The two tracts lying on Back Swamp we set off in three lots and

three tracts lying on and near White Oak River we set off in seven lots ... the following described allotment, viz.

Lot No. 1 lying immediately on White Oak River containing seventy five acres to children of John Hewit decd

Lot No. 2 joining lot No. one and containing sixty acres to Desire Hewit

Lot No. 3 joining lot No. two and containing Sixty acres to Willet Hewit

Lot No. 4 joining lot No. three containing seventy acres also sixty six and one third acres being one third part of an undivided tract joining the [plantation?] land to Teresa Hewit

Lot No. 5 joining lot No. four containing sixty acres [tear] [section?] the land eastern part of the Meadows tract which said tract joins the River tract which [said fifty?] acres [tear] lot five to Caleb S. Hewit and Louisa his wife.

Lot No. 6 joining lot No. five containing seventy acres also fifty acres on the back or Northern [stem?] part of the Meadows tract above mentioned and joining the fifty acres of said tract set off to lot No. five ... plat No. six to Rigdon P. Hewit

Lot No. 7 joining lot No. six and being the remaining part of the Meadows tract and containing one hundred acres to John Weeks and Emily his wife.

Lot No. 8 being a part of the Black Swamp tract and containing on hundred and fifty acres to Abram M. Hewit

Lot No. 9 a part of the Black Swamp tract joining lot No. eight and containing two hundred and fifty acres to Edward M. Hewit

Lot No. 10 a part of the said Black Swamp tract joining lot No. nine and containing one hundred acres also a tract of one hundred acres joining the same and also a separate tract lying on the eastern side of Black Swamp containing two hundred and twenty nine acres each of which tracts are marked in the above plat No. ten to Elijah Hewit

Estate of Rigdon Hewitt, Pollocksville 24 Feb 1844, Report of division of slaves

... We find the valuation of the whole of the slaves of said decd to be Seven Thousand two hundred and seventy five Dollars less one hundred Dollars for undervaluation of negro woman Esther, which sum divided in ten shares the number of heirs makes the distributive share of each the sum of Seven Hundred and twenty seven Dollars and fifty cents less ten Dollars each share for undervaluation of Esther on dividing the said slaves in lots agreeable tot he number of hears and drawing the same

John Hewit draws lot number four consisting of Simon valued at Five hundred Dollars and Rhoda valued at Three hundred Dollars and is to pay over Seventy two Dollars and Fifty cents.

Elijah Hewit draws lot No. six consisting of Balaam valued Three hundred and seventy five dollars and Hannah valued at Three hundred dollars and is to receive Fifty two Dollars and fifty cents.

Edward Hewit draws lot No. seven consisting of Daniel valued at Three hundred and seventy five dollars, Rose Mariam and [William?] valued together at Four hundred and twenty five Dollars and Esther undervalued at one hundred Dollars and is to receive twenty seven Dollars and fifty cent.

Abram M. Hewit draws lot No. eight consisting of David valued at Three hundred and twenty five Dollars and [Clary?] valued at Three hundred Dollars and is to receive one hundred and two Dollars and fifty cents.

Louisa Hewit draws lot No. ten consisting of Anaca [Cass/Carr?] and Dick valued together at Five hundred Dollars and Peggy valued at two hundred Dollars and is to receive twenty seven Dollars and fifty cents.

Rigdon P. Hewit draws lot No. five consisting of Jordan valued at Five Hundred Dollars and Matilda valued at three hundred Dollars and is to pay twenty two Dollars and fifty cents.

Emily Weeks draws lot No. nine consisting of [Ivy / Joy?] valued at Three Hundred Dollars and Crip Mustifer and Lisky valued together at Five Hundred and fifty Dollars and is to pay One Hundred and twenty two Dollars and fifty cents.

Teresa Hewit, Willit Hewit and Desire Hewit, minors, the remaining three lots consisting together of Moses, Ritty, Sam, Sophia, Edward, Kitty and Charity we throw back in common stock of said three minor heirs to be hereafter together with their increase and [hire?] divided among them.

The Petition of Timothy Haskins and Therese his wife, Daresay Hewit and Willet Hewit the two last infants suing in their behalf by Caleb S. Hewit there Guardian & next friend ... they are tenants in Common of the following named Slaves, viz. Sam, Moses, Ritty, Charity, Anna, and Sophia ...

petition the court to appoint "three freeholders" to partition the above slaves among the petitioners, or sell them and divide the proceeds.

Report of division of the remaining slaves of heirs of Rigdon Hewitt, 26 Dec 1846

... the whole amount of the valuation of said negroes to be twenty three hundred and fifty Dollars which divided in three parts the number of said heirs is Seven Hundred and eighty three Dollars and thirty three and one third cents to the distributive share ...

Sam valued at six hundred Dollars and Sophia valued at two hundred and fifty Dollars composing lot No. one

Moses valued at six hundred Dollars and Charity valued at one hundred and seventy five Dollars composing lot No. two

Kitty valued at Three Hundred and fifty Dollars Edward valued at seventy five Dollars and Ritty valued at three hundred Dollars composing lot No. three

Timothy Haskins one of the heirs to said negroes by his intermarriage with Teresa Hewit a daughter of said Rigdon Hewit decd drew lot No. three consisting as before stated of Kitty Edward and Ritty valued together at Seven Hundred and twenty five Dollars and the said Timothy Haskins is to receive from the guardian of said heirs Fifty eight Dollars thirty three and one third cents to make the amount of Seven Hudnred and eighty three Dollars thirty three and one third cents the distributive share as above stated.

... whereas heretofore in a division of negroes made in the County of Jones ... the following negro slaves were allotted and set apart in common between Willet Hewitt & Desire Hewitt now Farnell (viz, Sam, Moes, Sophia and Charity) ...

Aaron Farnell & wife Desire shall have Sam & Sophia...

Willet Hewitt shall have Moses & Charity...
