He settled in the area of Elyton in Jefferson Co., Alabama. He was active in county affairs until his death May 25, 1858."

Barnett Wilson's "Hewitt Family Update", Oct. 1991: "We have the will of James Hignight Hewitt dated [should read "probated"] Aug. 16, 1860. Children listed are as follows: Francis A. Hewitt, John S. Hewitt (Jack Shackleford) of La. [of full age], James T. Hewitt [of Elyton, Ala., of full age], G.W. Hewitt, Mary A. (Almira). Mary was 16 at this date and living with F.A. Hewitt. Robert G. Hewitt, 14 at this date living with guardian James T. Hewitt. Elizabeth A. Hewitt who was 24 at this date. It named a widow Martha. We do not know the date of this marriage or what her maiden name was. We do know that the time of the estate settlement she had intermarried with Edmund Wood and had relinquished her rights in the estate." Barnett has based his account on Book 170, Alabama Records, Probate Minutes Book 1860-1862, and Ala. Records #7 [Will Book A], page 55: "James H. Hewitt. Last will and testament dated 5 May 1858; codicil dated 6 May 1858; probated 17 July 1858. Wife Martha: all land belonging to the home place, which I bought of estate of J.B. Ayres. Witnesses: F.A. Hewitt, Tirey Love, Bennet Brake, James T. Hewitt. Proof of will - 15 June 1858. Martha Hewitt represents to your Honor that James H. Hewitt left as heir your petitioner, the widow, and 6 children, viz: Mary A. Hewitt, minor over 14; R.G. Hewitt, minor under 14, both residing in this county with said petitioner; J.S. Hewitt,
of full age, resides in Downsville, La; F.A. Hewitt, J.T. Hewitt, and G.W. Hewitt, all of full age and residing in Jefferson Co. Ala. James H Hewitt, the testator died 25th of May last at his late residence in this county."

bullet John HEWITT was a Constable between 1762 and 1775 in White Oak District, Onslow Co., NC.(55) John Simpson, who died in 1761, was formerly the constable. John Hewitt subsequently was named guardian for Simpson's children. He was named as guardian of Thomas and Abram Simpson on 10 Mar 1763 in Onslow Co., NC.(56) John Hewitt and Richard Pitts put up security for the estate of the orphans of John Simpson. John Simpson married Anne, the widow of Goldsmith Whitehurst, and had children Abram and Thomas Simpson. Thomas Hewitt married Elizabeth Whitehurst, daughter of Goldsmith and Anne. The Simpson children would have technically been half-brothers-in-law to Thomas Hewitt, and if Thomas and John Hewitt were brothers, then to John as well. He was ordered to release estate to Thomas Simpson. on 10 Nov 1769 in Onslow Co., NC.(57) He was in May 1773 in Onslow Co., NC. The patent of Edward Marcey mentions John Hewit as an adjoiner to his patent on Boiling Spring branch along with adjoiner Stephen Hawkins who is a witness to the will of Thomas Hewitt. He signed a will on 16 Oct 1775 in Onslow Co., NC.(58)

This Will was proved by the Oath of Spenser Linz Conaway and Thos Hewit qualifyed as Executor and Obtained Letters Testamentary July Court 1777. Teste: William [Crayland?]
He signed as a witness in Feb 1776 in Onslow Co., NC. Thomas and John Hewitt witness a deed from Benjamin and Silas Weeks concerning land on Whiteoak River, The Wharf (Swansboro), formerly occupied by Theophilus Weeks. At this time it is not clear if these are the elder John and Thomas, or two of the younger ones. He died in 1777 in Onslow Co., NC. Son John is named executor in the will, but Thomas is issued letters testamentary in the July Court 1777. This shows that the Thomas Hewitt who died by April Court 1777 could not have been the son of this John whose will was probated in July 1777. Parents: HEWITT.

He married to Mary about 1748.
It is possible that John's wife was Mary Willett, an older cousin of Abel and Willet Goffigon. The Goffigon brothers moved from Northampton Co., VA to Onslow Co., NC about 1761 with William and Caleb Goffigon. The Goffigon's were known to live next to John Hewitt by the early 1770s.

The given name Willett first shows up in the Hewitt line in this era.

Application states that he is 78 years old and served in the Revolutionary War. He died in Oct 1834 in Onslow Co., NC. He applied for a dowry in May 1835 in Onslow Co., NC.(60) "Elsey" Huett requested dower in the property of her deceased husband, John Huett who had died, intestate, in Oct 1834, possessed of a tract of land in Onslow Co. of about 30 ac. with a dwelling house on the same, lying on the E side of Mitchell Swamp adj. land of John Morton, David Ketchum and Luke Huggins. on 21 May 1835 "Alice" Hewit was granted 422.00 for her year's support.

In the abstract of the sheriff's deed of 1788 to John Hewit, son of John Hewitt dec'd, there is a notation of "30 ac. to John Hewit". Does this relate to above 30 ac. of this John who d. 1834? Parents: Thomas HEWITT and Elizabeth WHITEHURST.

The tax was 23.2 cents levied on 202.5 acres of land with Pine. He appeared on the census in 1840 in Macon Co., GA. Found in District 814 in the Garden Valley area. He died on 3 Feb 1842 in Macon Co., GA. Parents: Rigdon HEWITT and UNKNOWN.

The Caleb Smith family was known to associate with the early Hewitt's of the Whiteoak River area. The 1790 census record showing "Polly" Hewitt as the head of the household with a minor male child may imply that John belonged to Thomas and Mary. He appeared on the census in 1850 in White Oak District, Onslow Co., NC. (64) John (age 65) was living with wife Roda (age 64), son John (age 28), daughter Sarrah (age 18), and an elderly woman named Sarrah (age 72) who may have been his sister. He died between 1858 and 1865. He signed a will on 30 Mar 1858 in Onslow Co., NC.

In the name of God Amen. I John Hewit Sr. of the County of Onslow & State of North Carolina, being of sound mind and disposing memory do ordain and declare this my last will and testament revoking all others, in form and manner following
Item 1st It is my will and desire that all my just debts be paid out of my estate.
Item 2nd I loan to my wife Rhoda during her natural life or Widowhood all my estate both real and personal
Item 3rd I give unto my son John C. Hewit at the death of my wife Rhoda or in the event of her marrying agin all that part of my Plantation Bounded as follwos Beginning as follows at the mouth of the Field old mill rac where it empties in to the White Oak river, Thence runing up the various courses of the said mill race to the mouth of [complete line blotted] thence runing up the courses of said main [leading?] ditch where the main [Road?] now crosses at a bridge thence runing along the middle of another ditch due East Four Poles [thence South?] two poles thence [with?] another line in said ditch to ... Jabez Smith's corner ... White Oak river ... to the begining. My will and desire further is that my Son John C. Hewit shall have privilege of getting timber for buildings and plantation [uses?] on the east side of the above described line if he should [need?] it, to him his heirs and assigns forever
Item 4th I give unto my son John C. Hewit at the death of my wife Rhoda [or at the event of] her marrying again one half of my Personal estate his heirs and assigns forever
Item 5th I leave to Louisa Hewit, wife of my son Caleb S. Hewit the other half of my real estate bounded as follows Begining at the mouth of the aforesaid mill race thence runing along the several lines as designated in the bequest to my son John C. Hewit to a [ford?] ... Josiah Smith's corner ... White Oak River ... to the place of begining with the privilege of using [Cyprus?] timber for building purposes on said Land from the land set forth to my son John C. Hewit during her natural life or Widowhood to be held in trust by my executors hereafter mentioned and the profit arising therefrom to be applied for the support of her and her children, and in the event of her death or again marrying if she should Survive her husband myu son Caleb S. Hewit then the above described prperty with all appurtenances to be divided amongst the children of my Son Caleb S. Hewit [blotted] heirs & assigns forever.
Item 6th I loan to Louisa Hewitt wife of my son Caleb S. Hewit the other half of my personal estate during her lifetime or Widowhood to be held in trust by my Executors hereafter named and to profit arising theefrom to be appleid to support of her and her chidlren and in the even tof her death or again marrying then the above described property with all its increase to be equally divided among the childen of my on Caleb S. Hewit to them their heirs and assigns forever.
Item 7th I hold a note against my son Caleb S. Hewit for One hundred and [eighty-eight?] dollars bearing date this day Now in case the said Caleb S. Hewit does not pay the same during the life of myself or his mother then and in that event the one half what may be due on said not must be paid out of the portion of my estate loaned to Louisa Hewit wife of my son Caleb S. Hewit not [that?] my son John C. Hewit
Item 8th My son John C. Hewit also holds a note on the said Caleb S. Hewit for [one? two?] hundred & thirty-six dollars bearing date this day now in case this note is not Paid during my or his mother's life then I desire and do declare that the amount of said note due to him the said John C. Hewit Shall be Paid out of the portion of my estate loaned to Louisa Hewit wife of my son Caleb S. Hewit
Item 9th My will and desire is that the estate both real and personal loaned by me to Louisa Hewit wife of my son Caleb S. Hewit during her life or widowhood should it be deemed necessary by my executors herein after named they to be the judges [how? _______________] hereby authorized to make sale either private of publicly within two years after my thier mot my wife Rhoda demise and the proceeds of such sale Held in trust and applied to the support of Louisa Hewitt and her children during her lifetime or widowhood and at her demise or in the event of her again marrying the proceeds of any such sale as above stated should any be made to be equally divided among the children of my son Caleb S. Hewit
Item 10th I give unto my son Caleb S. Hewit the sum of Ten dollars to be paid out of that portion of my estate loaned to Louisa Hewit wife of my son Caleb S. Hewit
Item 11th I ordain and appoint my sons Caleb S. Hewit and John C. HewitExecutors & trustees to this my last will and testament this 30th day of March A.D. 1858

Hewit as they respectively become of age. March 30th 1858

NOTE: It is possible that the June 1884 date of submission of the will for probate reflects the death of Sarah E. (Weeks) Hewitt, the will being held until that time because of Sarah's life interest in the estate. A request for letters of administration by son-in-law B. W. Trott was not filed until Oct '95 (see below). Sarah E. and John C. Hewit are said to be buried in Maysville, NC.
He died on 8 Apr 1884 in Onslow Co., NC. One descendant lists him as John Calloway Hewitt. Parents: John HEWITT (P?) and Rhoda SMITH.

He obtained a marriage license on 4 Dec 1849 in Carteret Co., NC.(70) He married to Sarah Elizabeth WEEKS on 13 Dec 1849 in Carteret Co., NC.
